Considering that culture is the product of creative and human processes, it is believed that intellectual property is a legal tool that allows for its protection given that it helps conserve, safeguard and preserve its tangible and/or intangible assets. In the case of digital heritage, which is made up of digital elements that should be preserved due to their cultural value, some challenges have arisen regarding their legal protection. One of these challenges is the lack of clarity about how the (...) elements that comprise it should be protected, giving rise to doubts about how intellectual property should help solve this conflict. This article presents the discussion regarding the protection of digital heritage in Colombia, how copyright is becoming an instrument that contributes to its legal protection, and the challenges to further develop it in the country. Ante los hechos violentos que la población y en particular las mujeres padecen como grupo en México, este trabajo busca sumar al ejercicio crítico de pensar las violencias simbólicas y fácticas, mostrar sus formas de reconocimiento y el trabajo discursivo que apuesta por la vida de las mujeres y la población vulnerable no sólo desde el dolor y la rabia, sino también desde la apuesta por la supervivencia, por las estrategias que permitirían sustraerse al peso avasallador de sus formas, para (...) devenir otras. Este trabajo analiza el trabajo de escritoras que invitan a encontrar en sus reflexiones, historias, relatos y personajes femeninos no sólo a víctimas, sino a subjetividades que evitan por diferentes medios a quedar aprisionadas por conceptos que sólo reiteran la violencia en sus cuerpos y en sus vidas. Cognitive symptoms after COVID-19 have been increasingly recognized several months after the acute infection and have been designated as “brain fog.” We report a patient with cognitive symptoms that started immediately after COVID-19, in which cerebrospinal fluid biomarkers were highly suggestive of Alzheimer’s disease. Our case highlights the need to examine patients with cognitive symptoms following COVID-19 comprehensively. A detailed assessment combining clinical, cognitive, and biomarker studies may help disentangle the underlying mechanisms associated with cognitive dysfunction in each case. En este artículo analizo las críticas recientes de Judith Butler al escepticismo cartesiano y al constructivismo posmoderno, para explicar el distanciamiento de Butler respecto de posturas constructivistas y, al mismo tiempo, como un argumento para afirmar la dimensión ética y con pretensión de universalidad de su defensa de las vidas precarias.

En este artículo quisiera aludir a las tesis de Bourdieu sobre la dominación simbólica, incidiendo en su faceta androcéntrica; para, a continuación contemplar cómo, debido al carácter incorporado de dicha estructura (esto es, a que su eficacia radica en que el dominado contribuye a su propia dominación), algunas teorías y prácticas feministas, como el feminismo de la diferencia de Luce Irigaray, los planteamientos éticos y políticos de Benhabib y la subversión de la identidad que promueve Butler, pueden llegar a reproducir (...) las diferencias que pretendían combatir. Finalmente, quisiera plantear las opciones que pueden llevar a cabo los distintos feminismos (y otras figuras dominadas) para evitar estos problemas. (shrink)

The main interest of this paper is to understand how different theories have influence in the anthropological study of boundaries spaces. First, I will refer to Wolf’s and Barth’s critique against the particularism of the first ethnographies. These first anthropologists maintained an isolated and separated conception of culture and consequently, they were unable to apprehend links between different human groups. In contrast, I will mention new approaches, more sensible to the differential situations in borders and the existence of transnational nets (...) among regions. Lastly, I will allude to the difficulties that three contemporary anthropologists must face, when they link these new approaches with some postmodern concepts and therefore, they cannot apprehend either the complexity of the boundaries. En este artículo se va a tratar de comprender cómo la elección del marco teórico va a tener consecuencias en la realidad estudiada, en el caso concreto de la antropología de los espacios fronterizos. En primer lugar, nos referiremos a las críticas de Wolf y Barth al particularismo característico de las primeras etnografías, dado su concepto aislado y cerrado de cultura, que les impedía reconocer los vínculos y contactos entre distintos grupos humanos. Como contraste a los particularismos, recientemente han aparecido nuevos enfoques teóricos, más atentos a las realidades fronterizas y al establecimiento de redes transnacionales entre distintas regiones; entre ellos, destacaremos las aportaciones de tres antropólogos contemporáneos quienes vinculan los enfoques transnacionales con algunos conceptos propios de la filosofía posmoderna y como consecuencia tienen dificultades aprehender la complejidad de los espacios fronterizos. En este artículo quisiera contemplar los argumentos de dos autores muy distintos, Seyla Benhabib y Slavoj Žižek, quienes coinciden en señalar que la aportación de Judith Butler a la filosofía política no resulta demasiado convincente por no considerar la tendencia utópica que toda teoría y práctica política debería mantener. Nos aproximaremos en orden cronológico a estas dos críticas, orden que nos va a permitir entender mejor la evolución del pensamiento de Butler.

En este artículo voy a profundizar en una interpretación aplicada de la obra del segundo Wittgenstein, propuesta por José Medina, Miranda Fricker y Peg O’Connor, entre otros. Estos autores equiparan juegos de lenguaje y formas de vida, entienden las reglas de los juegos como normas sociales y trasladan la argumentación del filósofo vienés a un ámbito sociopolítico. Concretamente, José Medina propone un argumento en oposición a los juegos de lenguaje sociales, que es la versión social al argumento de Wittgenstein en (...) oposición a los juegos de lenguaje privados. En segundo lugar, analizaré dos casos: las distintas denominaciones de los indios huicholes y el uso del plural inclusivo por parte de algunos feminismos. Lo más interesante de estos dos casos es que estos grupos proponen significados privados o usos del lenguaje que sólo parecen ser válidos para ellos. Preguntaré si estos usos se pueden entender como juegos de lenguaje sociales y ser criticados desde los argumentos de Medina. Este estudio de casos servirá para evaluar la adecuación, validez y límites de esta interpretación de la obra de Wittgenstein. (shrink)

En este artículo desarrollo una crítica hacia posturas transexcluyentes, que niegan el reconocimiento como mujeres de las mujeres trans, bajo la óptica de la filosofía del lenguaje cotidiano del segundo Wittgenstein. Aunque este autor nunca se posicionó en ese tema, varias de sus intérpretes feministas, como Toril Moi, Cressida Heyes y Hilde Lindemann-Nelson, han elaborado una crítica antiesencialista para evitar el reduccionismo biológico del término «mujer» y ampliar su uso. Siguiendo a estas filósofas, mi tesis es que varios contenidos de (...) la obra tardía de Wittgenstein (uso cotidiano del lenguaje, argumento contra el juego de lenguaje privado, parecidos de familia y conceptos de límites borrosos) pueden contribuir a aclarar ciertos usos del concepto de «mujer» y a criticar los presupuestos esencialistas que subyacen a las propuestas feministas transexcluyentes. Neurosurgery for psychiatric disorders, also sometimes referred to as psychosurgery, is rapidly evolving, with new techniques and indications being investigated actively. Many within the field have suggested that some form of guidelines or regulations are needed to help ensure that a promising field develops safely. Multiple countries have enacted specific laws regulating NPD. This article reviews NPD-specific laws drawn from North and South America, Asia and Europe, in order to identify the typical form and contents of these laws and to (...) set the groundwork for the design of an optimal regulation for the field. Key challenges for this design that are revealed by the review are how to define the scope of the law, what types of regulations are required, and how to approach international harmonization given the potential migration of researchers and patients. Introduction As deep brain stimulation (DBS) has shifted to being used earlier during Parkinson’s disease (PD), data is lacking regarding patient specific attitudes, preferences, and factors which may influence the timing of and decision to proceed with DBS in the United States. This study aims to identify and compare attitudes and preferences regarding the earlier use of DBS in Parkinson’s patients who have and have not undergone DBS. Methods We developed an online survey concerning attitudes about DBS and its timing (...) in PD. The survey was distributed nationally in the United States via the Michael J. Fox Foundation Trial Finder, the American Parkinson Disease Association flyers, and as a link on the Parkinson Alliance website. Differences in responses between PD DBS and non-DBS patients were assessed. Results A total of 445 patients with PD met eligibility criteria for the survey of which 160 self-identified as having undergone DBS. Fifty-five percent (n = 124) of non-DBS patients believed that DBS for PD should only be considered after all medication options have been tried. Patients favoring early DBS had fewer concerns regarding the surgery than those favoring later DBS. Conclusion Our findings highlight a variety of important considerations and concerns patients have regarding DBS and its timing. These viewpoints are important aspects of shared decision-making, as they help to identify patients’ preferences, values, and goals, which should enable providers to better navigate, with their patients, the decision path for therapeutic options to consider. Parental burnout is a unique and context-specific syndrome resulting from a chronic imbalance of risks over resources in the parenting domain. The current research aims to evaluate the psychometric properties of the Spanish version of the Parental Burnout Assessment across Spanish-speaking countries with two consecutive studies. In Study 1, we analyzed the data through a bifactor model within an Exploratory Structural Equation Modeling on the pooled sample of participants obtaining good fit indices. We then attained measurement invariance across both gender (...) and countries in a set of nested models with gradually increasing parameter constraints. Latent means comparisons across countries showed that among the participants’ countries, Chile had the highest parental burnout score, likewise, comparisons across gender evidenced that mothers displayed higher scores than fathers, as shown in previous studies. Reliability coefficients were high. In Study 2, we tested the relations between parental burnout and three specific consequences, i.e., escape and suicidal ideations, parental neglect, and parental violence toward one’s children. The medium to large associations found provided support for the PBA’s predictive validity. Overall, we concluded that the Spanish version of the PBA has good psychometric properties. The results support its relevance for the assessment of parental burnout among Spanish-speaking parents, offering new opportunities for cross-cultural research in the parenting domain. (shrink)

Adolescence is the period of growth between childhood and adulthood. This period of development, which goes from 13 to 18 years, is usually presented as critical, due to the profound modifications of physiological and psychological order in this research we worked with a sample of 60 students, from Secondary School No. 8, morning and evening shift. An instrument was made with 45 variables, 5 of them signalytic: age, gender, an average of the previous cycle, performing some extracurricular activity, and shift. (...) The information was processed in the SPSS and STATISTIC programs. The conclusions showed that the student, by showing a need to learn, is able to develop different academic skills through different factors, such as motivation, thus improving their school performance. Thus proposes the development of an intervention model, for training teachers, on motivation methods in the classroom; As well as conferences on the importance of the topic of adolescent motivation and the factors involved in improving academic performance, teachers and parents will be taught and publicity will be developed on the importance of school motivation in adolescents and how it intervenes from home, at school and how this influences academic results. The laudatory assessment of Kant as a philosophical innovator promoted by Germaine de Staël is questioned and his moral epistemology examined in relation to that of Elise Reimarus, Catharine Cockburn, Catharine Macaulay, and Isabelle de Charrière. The moral and political philosophies of the first three, grounded in natural law, are used to undermine Staël's claim that Kant's moral philosophy offers a (...) significant advance over Locke's, a conclusion reinforced through a reading Charrière's critique of Kant. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. According to Margaret Cavendish the entire natural world is essentially rational such that everything thinks in some way or another. In this paper, I examine why Cavendish would believe that the natural world is ubiquitously rational, arguing against the usual account, which holds that she does so in order to account for the orderly production of very complex phenomena (e.g. living beings) given the limits of the mechanical philosophy. Rather, I argue, she attributes ubiquitous rationality to the natural world in (...) order to ground a theory of the ubiquitous freedom of nature, which in turn accounts for both the world's orderly and disorderly behavior. There are many ways of interpreting the so-called new technologies. One of the most interesting is that which stems from defining them as a social imaginary, and therefore, as collective beliefs, fears and hopes. It is common to attribute to technologies all manner of threats that, founded or not, are real in the measure that the society makes decisions and acts in a way consistent with this conviction.The fears and anxieties of society lead to a consideration of the limits of (...) the human that technologies transgress. Among the figures with which one speaks about these limits there is Frankenstein, the modern Prometheus, which threatens modern fantasies with its deformity. There is, however, another man-made creature that can serve to orient our reflection, the Golem.In 1609, 400 years ago, Rabbi Loew died. He is credited with the creation of a homunculus by combining of secret codes. The problem of the Golem was its imperfect soul made manifest in its lack of speech. Its silent presence was a source of great fear in the community that finally asked to get rid of the creature.These figures of monstrosity, Frankenstein and above all Golem, will help us to make technologies understand from the fear that society projects onto them, and this will lead us to the question concerning the imaginary fears of the technological system. A theoretical physicist and feminist theorist, Karen Barad elaborates her theory of agential realism, a schema that is at once a new epistemology, ontology, and ethics.

We frequently speak of certain things or phenomena being built out of or based in others. Making Things Up concerns these relations, which connect more fundamental things to less fundamental things: Karen Bennett calls these 'building relations'. She aims to illuminate what it means to say that one thing is more fundamental than another.

Between 1653 and 1655 Margaret Cavendish makes a radical transition in her theory of matter, rejecting her earlier atomism in favour of an infinitely-extended and infinitely-divisible material plenum, with matter being ubiquitously self-moving, sensing, and rational. It is unclear, however, if Cavendish can actually dispense of atomism. One of her arguments against atomism, for example, depends upon the created world being harmonious and orderly, a premise Cavendish herself repeatedly undermines by noting nature’s many disorders. I argue that her supposed difficulties (...) with atomism expose a deeper tension in her work between two fundamental metaphysical commitments each of which has substantial philosophical support: her monist theory of the material world (which maintains that there exists just one natural substance which is the single principal cause) and her occasional theory of causation (which requires multiple finite principal causes in nature -- causes that might be considered individual substances). Her monism undermines atomism while her theory of occasional cause seems to rest on a conception of nature that would be especially friendly to atomism. I argue further that we can solve this tension within a Cavendishian framework in such a way as to preserve her theory of causation and her monism, but that this solution depends upon our taking her monism in a particular (and weak) form. I finally note that we can best make sense of her unique and interesting form of monism by acknowledging her social-political motivations in addition to her motivations in natural philosophy. Despite journalism’s commitment to ethical principles such as accuracy, humanity and diversity, compliance with the gender perspective in content is still minimal in approximately one hundred countries. This inequality reinforces misperceptions, imbalances, and perceived differences between men and women. To address this situation, from 2010 to 2021, eight Spanish media companies appointed a new editorial position responsible for self-regulating gender equality. This qualitative study focused on 10 journalists who currently exercise or have exercised that job, to detect, describe and propose (...) the implementation of this new professional role. This study suggests that gender editing has advanced equality in parity of sourcing and the presence of women in the opinion sections, but implementation of equality in overall content is more difficult. Gender editors’ daily work is hampered by a lack of management support and an absence of independence in editorial decisions. (shrink)

Resumen El objetivo principal del presente trabajo es analizar la atenuación en los actos asertivos en entrevistas sociolingüísticas a fin de entender cómo se construye la imagen de afiliación en la cultura mexicana. En este trabajo la imagen de afiliación se define como el deseo de ser aceptado por un grupo. Nos interesa determinar si la realización de estos actos asertivos son amenazas eventuales a la imagen social de los informantes y si tienen una función atenuadora. El corpus que se (...) analizó consistió en segmentos seleccionados de 12 entrevistas, 6 de hombres y 6 de mujeres, del corpus oral “El habla de Monterrey–PRESEEA” correspondientes a informantes entre 35 y 54 años que concluyeron sus estudios de licenciatura. El análisis de este corpus oral muestra aspectos importantes, a saber, nos presenta que existen similitudes y diferencias entre los dos grupos pues tanto hombres como mujeres utilizaron la justificación para atenuar su punto de vista. En cuanto a diferencias, las mujeres emplearon más estrategias de atenuación que los hombres. Por otra parte, el análisis de los datos sugiere que la atenuación, como categoría pragmática, contribuye a caracterizar la imagen de afiliación de nuestros informantes. (shrink)

In the ninth century BCE, the peoples of four distinct regions of the civilized world created the religious and philosophical traditions that have continued to nourish humanity to the present day: Confucianism and Daoism in China, Hinduism and Buddhism in India, monotheism in Israel, and philosophical rationalism in Greece. Later generations further developed these initial insights, but we have never grown beyond them. Rabbinic Judaism, Christianity, and Islam, for example, were all secondary flowerings of the original Israelite vision. Now, in (...) The Great Transformation , Karen Armstrong reveals how the sages of this pivotal “Axial Age” can speak clearly and helpfully to the violence and desperation that we experience in our own times. Armstrong traces the development of the Axial Age chronologically, examining the contributions of such figures as the Buddha, Socrates, Confucius, Jeremiah, Ezekiel, the mystics of the Upanishads, Mencius, and Euripides. All of the Axial Age faiths began in principled and visceral recoil from the unprecedented violence of their time. Despite some differences of emphasis, there was a remarkable consensus in their call for an abandonment of selfishness and a spirituality of compassion. With regard to dealing with fear, despair, hatred, rage, and violence, the Axial sages gave their people and give us, Armstrong says, two important pieces of advice: first there must be personal responsibility and self-criticism, and it must be followed by practical, effective action. In her introduction and concluding chapter, Armstrong urges us to consider how these spiritualities challenge the way we are religious today. In our various institutions, we sometimes seem to be attempting to create exactly the kind of religion that Axial sages and prophets had hoped to eliminate. We often equate faith with doctrinal conformity, but the traditions of the Axial Age were not about dogma. All insisted on the primacy of compassion even in the midst of suffering. In each Axial Age case, a disciplined revulsion from violence and hatred proved to be the major catalyst of spiritual change. (shrink)

Biobanks correspond to different situations: research and technological development, medical diagnosis or therapeutic activities. Their status is not clearly defined. We aimed to investigate human biobanking in Europe, particularly in relation to organisational, economic and ethical issues in various national contexts. Data from a survey in six EU countries were collected as part of a European Research Project examining human and non-human biobanking. A total of 147 institutions concerned with biobanking of human samples and data were investigated by questionnaires and (...) interviews. Most institutions surveyed belong to the public or private non-profit-making sectors, which have a key role in biobanking. This activity is increasing in all countries because few samples are discarded and genetic research is proliferating. Collections vary in size, many being small and only a few very large. Their purpose is often research, or research and healthcare, mostly in the context of disease studies. A specific budget is very rarely allocated to biobanking and costs are not often evaluated. Samples are usually provided free of charge and gifts and exchanges are the common rule. Good practice guidelines are generally followed and quality controls are performed but quality procedures are not always clearly explained. Associated data are usually computerised. Biobankers generally favour centralisation of data rather than of samples. Legal and ethical harmonisation within Europe is considered likely to facilitate international collaboration. We propose a series of recommendations and suggestions arising from the EUROGENBANK project. (shrink)

This paper aims to contribute to the existing literature on normative cognition by providing a lineage explanation of human social norm psychology. This approach builds upon theories of goal-directed behavioral control in the reinforcement learning and control literature, arguing that this form of control defines an important class of intentional normative mental states that are instrumental in nature. I defend the view that great ape capacities for instrumental reasoning and our capacity (or family of capacities) for shared intentionality coadapted to (...) each other and argue that the evolution of this capacity has allowed the representation of social norms and the emergence of our capacity for normative guidance. In this paper I describe and defend an account of virtuous motivation that differs from what we might call ordinary moral motivation. It is possible to be morally motivated without being virtuously motivated. In the first half of the essay, I explore different senses of moral motivation and the philosophical puzzles and problems it poses. In the second half, I give an account of virtuous motivation that, unlike ordinary moral motivation, requires the motivational structure characteristic of a fully virtuous person. (...) I draw on Aristotle's account of virtuous action to argue that a fully virtuous agent's judgment reflects a robust form of moral knowledge about what features of an action render it virtuous and hence, choiceworthy. Virtuously motivated actions are chosen in light of those features and are accompanied by the affective state appropriate to the overall moral landscape in which the judgment is made. (shrink)

Recently much has been made of the grounding relation, and of the idea that it is intimately tied to fundamentality. If A grounds B, then A is more fundamental than B (though not vice versa ), and A is ungrounded if and only if it is fundamental full stop—absolutely fundamental. But here is a puzzle: is grounding itself absolutely fundamental?

This book discusses the notion that quantum gravity may represent the "breakdown" of spacetime at extremely high energy scales. If spacetime does not exist at the fundamental level, then it has to be considered "emergent", in other words an effective structure, valid at low energy scales. The author develops a conception of emergence appropriate to effective theories in physics, and shows how it applies (or could apply) in various approaches to quantum gravity, including condensed matter approaches, discrete approaches, and loop (...) quantum gravity. La libertad es una de las realizaciones humanas que más se valoran, pero que a la vez es más fácil de perder, la gran mayoría de las veces de forma voluntaria. Los lamentos más usuales son: hemos perdido la libertad, o nuestra libertad está en peligro; pocas veces se dice: hemos entregado la libertad, o, sólo sabemos vivir encadenados. Pero además, se asume la libertad como algo dado, sin más, y no se toma en cuenta que es un estado o (...) condición que hay que preservar, si se tiene, y luchar por incrementarlo. De hecho, la vida es una lucha constante por aumentar la libertad. Otros aspectos incorporados a este ensayo son la fundamentación del sistema de libertades en la libertad individual –siguiendo muy de cerca a Mill-, las características de ese sistema de libertades y el cuestionamiento a las doctrina del “interés nacional” o del “interés general”, como formas veladas de colectivismo, muy estimadas en América Latina. Dummett's output has been prolific and highly influential, but not always as accessible as it deserves to be. This book sets out to rectify this situation.

A variety of relations widely invoked by philosophers—composition, constitution, realization, micro-basing, emergence, and many others—are species of what I call ‘building relations’. I argue that they are conceptually intertwined, articulate what it takes for a relation to count as a building relation, and argue that—contra appearances—it is an open possibility that these relations are all determinates of a common determinable, or even that there is really only one building relation.

Discussions about the evolution of human social cognition usually portray the social environment of early hominins as highly hierarchical and violent. In this evolutionary narrative, our propensity for violence was overcome in our lineage by an increase in our intellectual capacities. However, I will argue in this article that we are at least equally justified in believing that our early hominin ancestors were less aggressive and hierarchical than is suggested in these models. This view is consistent with the available comparative (...) and palaeoanthropological evidence. Discussions about the evolution of human social cognition usually portray the social environment of early hominins as highly hierarchical and violent. In this evolutionary narrative, our propensity for violence was overcome in our lineage by an increase in our intellectual capacities. However, I will argue in this article that we are at least equally justified in believing that our early hominin ancestors were less aggressive and hierarchical than is suggested in these models. This view is consistent with the available comparative (...) and palaeoanthropological evidence.
